1. Agreement
These Terms of Service ("Terms") are a contract between you and One-Pochi ("One-Pochi", "we", "us", or "our"). By creating a workspace, joining a workspace, accessing the app, or otherwise using One-Pochi (the "Service"), you agree to these Terms and to our Privacy Policy.
If you use One-Pochi for a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. The Service
One-Pochi is a bilingual English/Japanese customer relationship management tool built for Google Workspace. It uses Google Apps Script and Google Sheets to provide CRM features such as contacts, pipelines, interactions, AI-assisted capture, analytics, team roles, and workspace setup.
Using One-Pochi requires a Google account, your authorization of the Google permissions shown on Google's consent screen, and an approved workspace or active plan when billing applies. Some features may require third-party services such as Google Gemini API or Stripe.
3. Your data and workspace
- You own your CRM records. CRM records entered into your workspace spreadsheet are yours or your organization's. We do not claim ownership of them.
- The workspace owner controls the sheet. The person or organization that owns the underlying Google Sheet controls that spreadsheet and its Google sharing settings.
- One-Pochi roles do not replace Google sharing settings. Removing a team member in One-Pochi may not automatically revoke that person's access to the underlying Google Sheet. Workspace owners should also review Google Drive sharing.
- You are responsible for your content. You are responsible for the legality, accuracy, and permissions associated with customer data, contact records, notes, and other content you put into the Service.
- Backups are your responsibility. Because your CRM records live in Google Sheets, you can use Google Sheets, Google Drive, or Google Takeout to copy, export, or back up your data.
4. Acceptable use
You agree not to use One-Pochi to:
- violate any law or regulation, including privacy, data protection, anti-spam, export control, or consumer protection laws;
- store or process data that you do not have the right to collect, store, or use;
- harass, deceive, defraud, or unlawfully profile people;
- attempt to breach, disrupt, overload, reverse engineer, or bypass the Service or its usage controls;
- share, resell, sublicense, or provide One-Pochi as your own product or service without our written permission;
- misrepresent your identity, team size, license status, or authority to use a workspace.
5. Plans, billing, cancellation, and refunds
- Beta access. One-Pochi may be free during beta. Beta access may be limited, changed, suspended, or ended as the product evolves.
- Subscriptions. Paid subscription plans are expected to be billed through Stripe and renew automatically unless canceled. Cancellation takes effect at the end of the current billing period unless stated otherwise.
- Access control. We may restrict, suspend, or end app access if a workspace is not approved, a required payment fails, or a user no longer has permission to use the workspace.
- Lifetime licenses. A lifetime license, if offered, gives access to the stated One-Pochi plan for as long as we operate the Service, subject to these Terms. Lifetime licenses are not transferable unless we agree in writing.
- Price changes. We may change subscription prices with reasonable notice before the new price applies. Price changes do not change an already purchased lifetime license unless required by law or by a third-party dependency outside our control.
- Refunds. Unless stated otherwise at purchase, first-time paid customers may request a refund within 14 days by emailing support@onepochi.com. After that period, payments are non-refundable except where required by law.
- Taxes. Prices may exclude taxes. You are responsible for applicable taxes unless we are required to collect them.
6. Beta and preview features
One-Pochi is currently in beta. Beta, pilot, preview, or experimental features may be incomplete, unavailable, changed, or discontinued at any time. You should not rely on beta features for critical workflows without appropriate backups and review.
7. AI features
AI-assisted features, such as business card scanning or inbox parsing, may produce incomplete or inaccurate output. You are responsible for reviewing AI-generated or AI-extracted information before relying on it or saving it to your workspace.
8. Third-party services
One-Pochi depends on services we do not control, including Google Apps Script, Google Sheets, Google OAuth, Google Gemini API, Google Cloud systems, and Stripe. Their availability, terms, pricing, or technical behavior may change, and those changes may affect One-Pochi. Your use of third-party services may also be subject to their separate terms and policies.
9. Intellectual property and feedback
We own One-Pochi, including its software, design, branding, documentation, and related intellectual property, except for your content and third-party materials. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while you comply with the Terms and maintain any required plan.
If you send feedback, suggestions, ideas, or bug reports, you allow us to use them without restriction or obligation to you.
10. Suspension and termination
You may stop using One-Pochi at any time and may revoke Google permissions from your Google Account. We may suspend or terminate access if you breach these Terms, fail to pay required fees, create security or legal risk, misuse the Service, or if we must comply with law or third-party platform requirements. Where practical, we will provide notice.
Termination of app access does not delete the underlying Google Sheet controlled by you or your workspace owner.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnity
You will defend, indemnify, and hold us harmless from claims, damages, liabilities, costs, and expenses arising from your content, your use of the Service, your breach of these Terms, or your violation of law or third-party rights.
14. Governing law and disputes
These Terms are governed by the laws of the State of Kansas, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Kansas, USA, unless applicable law requires another forum. Before filing a claim, you agree to contact us so we can try to resolve the issue informally.
15. Changes to these Terms
We may update these Terms as One-Pochi changes. If changes are material, we will update the effective date and provide notice through email, in-app notice, or the website. Continued use after changes take effect means you accept the updated Terms.
